StonehamBank Electronic Notices Disclosure and Consent

This Electronic Notices Disclosure and Consent ("Consent") contains important information about our Online Account Opening Application and provisions of disclosures and notices required by applicable law to you, including: the terms and conditions for online access to your deposit account(s) and disclosures related to the provision of our online banking service (the "Service"); the Deposit Account Agreement, Funds Availability Policy, Truth in Savings Disclosure(s), Customer Identification Notice, Privacy Notice, Electronic Fund Transfer Agreement and Disclosures; and other communications which we are required to send you with respect to any account or service you receive from us which you designate as part of this Service. This Consent also contains important information about how we will deliver disclosures, periodic statements and notices required by applicable law to you, including the Online Banking Agreement and Disclosure and the Bill Payment Agreement and Disclosure (collectively the "Agreement"), the Electronic Fund Transfer Agreement and Disclosures, our annual privacy notice, and all other communications about our online bill payment and other Internet banking services. We will use the term "Notice" to refer to the Agreement, any required disclosures and all other communication with you about StonehamBank's online banking services. We will use the term "Statement" to refer to any periodic statements and other notices, including notices of changes in terms, regarding your deposit accounts. This is your copy of the Consent. Please read it carefully and print or download and retain a copy of it for your records.

In this Consent, "we", "us" and "our" mean StonehamBank, and "I", "you" and "your" means each applicant listed in the web application.

Consent to Electronic Notices. After you have read this Consent, you must agree and give your consent to receive Notices, Statements, related disclosures required by law, and other communications from us electronically via the Service. By clicking the button labeled ‘Accept’ or ‘I Accept’”, which represents your electronic signature, you certify that you are an authorized signer of the account(s); that you understand you are legally bound; and that any transaction performed pursuant to this Consent shall be considered authorized by you. If the account is a joint account, the electronic authorization by any joint account holder applies to all account holders and shall be considered authorized by all joint owners.

Consent to Electronic Notices and Electronic Statements. By clicking on the ‘Accept’ or ‘I Accept’ button on the StonehamBank Online Account Opening or Online Banking enrollment pages, you affirmatively consent to receive all Notices electronically, whether sent by e- mail or other electronic means or made available via the Service or on our website. You may also be offered the option to receive Statements electronically. These will be referred to as "e-Statements." You agree that by accessing our web site, you satisfy the hardware and software requirements discussed more fully below and you have reasonably demonstrated that you can access, receive and retain Notices and Statements, if applicable, electronically in the formats we use.

The decision to do business electronically is yours. You cannot apply for an account using the Online Account Opening Application unless you agree to receive the Notices in electronic form. Paper copies of the Notices will no longer be delivered to you by postal mail. You may request paper copies of the Notices by calling us at 1-888-402-2265. Paper copies of the Notices will be provided to you at no cost. You cannot subscribe to StonehamBank Online Banking unless you agree to receive Notices in electronic form. However, e-Statements are optional.

Receiving Electronic Notices and Statements. We may provide Notices as part of your account opening process or post Notices on the StonehamBank Online Account Opening Application with appropriate notification to you as permitted by applicable law. We will consider your acceptance of this Consent as your confirmation of receipt of the Notice. As part of the account opening process, we will be communicating with you via email. You understand and agree that your mailing address, e-mail address and other account information may not change during the account opening process. Once your account is opened, you agree to notify us promptly if your mailing address, e-mail address or other information changes by calling us at 1-888-402-2265, writing to us at 80 Montvale Avenue, Attention: Deposit Operations, Stoneham, MA 02180, or sending us a secure e-mail via the messaging center in your online banking profile.

We may send Notices to an e-mail address you designate or post Notices on the StonehamBank web site with appropriate notice to you as permitted by applicable law. We will make e-Statements available on StonehamBank Online Banking, with appropriate notice to you. After account opening, we will treat any Notice or e-Statement we send or make available to you electronically as if it were sent by U.S. mail, postage prepaid, and will consider any such Notice or e-Statement received within 3 calendar days of the date sent or made available by us, even if you do not receive the e-mail or access StonehamBank Online Banking during that time. You may request a paper copy of any account Statement and understand that a fee may be charged for any such paper copies in accordance our fee schedule. You agree to notify us promptly if your mailing address, e-mail address or other information changes by calling us at 1-888-402-2265, writing to us at 80 Montvale Avenue, Attention: Deposit Operations, Stoneham, MA 02180, or sending us a secure e-mail via the messaging center in your Online Banking profile.

It is your responsibility to promptly examine each e-Statement and to notify us of any unauthorized payments within 60 days of the date on which we send the email notifying you that your e-Statement is available for viewing. e-Statement will be available electronically for a period of at least 18 months. Thereafter, the oldest e-Statements may be deleted as more recent e-Statements become available through the Service.

Hardware and Software Requirements. In order to access the StonehamBank web site, including StonehamBank Online Banking, and to access, receive and retain the Notices or Statements electronically, you must satisfy the hardware and software requirements detailed below. We will give you Notice of any change to these hardware and software requirements if the proposed change will adversely affect your ability to access, receive and retain subsequent electronic Notices or Statements from us. The hardware and software requirements, which you must satisfy at your own expense, are as follows:

  • An Internet web browser which is SSL-compliant and has a "secure mode," such as MS Internet Explorer, Firefox, Chrome or Safari;
  • A personal computer or other access device which is capable of accessing the Internet (e.g. you must have a modem and available telephone line, cable Internet connection or other means to access the Internet), and you must have an active email account capable of interfacing with the StonehamBank web site server and StonehamBank Online e-mail server, such as Microsoft Outlook, Outlook Express or America Online; and
  • Sufficient electronic storage capacity on your computer's hard drive or other data storage unit, or a printer that is capable of printing from your Internet web browser and e-mail software.

You confirm that your computer satisfies these specifications and requirements and that you can access, receive and retain the Notices electronically.

Withdrawal of Consent to Electronic Notices. If you agree to receive Notices or Statements electronically, you can withdraw your consent at any time by calling us at 1-888-402-2265, writing to us at 80 Montvale Avenue, Attention: Deposit Operations, Stoneham, MA 02180, or sending us a secure email via the messaging center in your StonehamBank Online Banking profile. Your withdrawal shall become effective as soon as we have had a reasonable opportunity to act on your request. If you withdraw your consent to receive Notices electronically, no fee will be imposed, but the Agreement and your access to, and use of, the web account opening and the Service will automatically be terminated and your Access ID will be deactivated. You may withdraw your consent to receive Statements electronically at any time using StonehamBank Online Banking or one of the methods described above. This will not terminate or affect your use of the Service, and we will send you paper Statements instead of electronic Statements. We will not impose any additional fees if you withdraw your consent to receive Statements electronically. Your withdrawal of this Consent will not affect the legal validity, enforceability and binding effect of any Notice or e-Statement sent before the effective date of termination of this Consent. For more information about your rights and obligations upon terminating the Agreement, please see the section of the Agreement entitled "Terminating this Agreement."

BY CLICKING THE ‘ACCEPT’ or ‘I ACCEPT’  ("THE CONSENT"), YOU ACKNOWLEDGE THAT YOU HAVE RECEIVED AND READ THIS CONSENT AND HAVE PRINTED A COPY OF IT FOR YOUR RECORDS. YOU FURTHER ACKNOWLEDGE THAT YOU HAVE REASONABLY DEMONSTRATED YOU ARE ABLE TO ACCESS ELECTRONICALLY AND RETAIN NOTICES PROVIDED PURSUANT TO THE SERVICE, AND THAT YOU CAN ACCESS, RECEIVE AND RETAIN THE NOTICES ELECTRONICALLY IN THE FORMATS WE USE, AND AFFIRMATIVELY CONSENT TO THE RECEIPT OF THE NOTICES ELECTRONICALLY.
